DMCA Policy

If you believe that content on Xither infringes your copyright, please submit a written notification ("DMCA Notice") to our designated copyright agent. Your notice must include all of the following elements required by 17 U.S.C. § 512(c)(3):

1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: A description of the material you claim is infringing, with sufficient detail to allow us to locate it on the Service (e.g., URL, page title, screenshot).
3. Your contact information: Your name, address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
6. Physical or electronic signature: Your physical or electronic signature.

Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

Send DMCA Notices to our designated copyright agent:

Upon receipt of a valid DMCA Notice, Xither will:

1. Promptly remove or disable access to the allegedly infringing content
2. Notify the user who posted the content that it has been removed
3. Provide the user with a copy of the DMCA Notice (with your contact information redacted if requested)
4. Inform the user of their right to submit a counter-notification

We will also document the notice and our response as required by the DMCA's repeat infringer policy.

If you believe that content you posted was removed in error — for example, because you have authorization to use the content or the material is not protected by copyright — you may submit a counter-notification to our copyright agent.

A valid counter-notification must include:

1. Identification of removed content: A description of the material that was removed and the location where it appeared before removal (e.g., URL).
2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district in which Xither may be found), and that you will accept service of process from the person who submitted the DMCA Notice.
4. Your contact information: Your name, address, telephone number, and email address.
5. Physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action.

In accordance with the DMCA and other applicable laws, Xither maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to the Service for users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

This DMCA Policy applies to copyright infringement claims only. If you believe content on Xither infringes your trademark rights, please use our contact form with details of the alleged infringement.
