DMCA Policy

If you believe content on Xither infringes your copyright, send a notice through our contact form and choose “Legal, privacy or DMCA.” Under 17 U.S.C. § 512(c)(3) your notice must include:

1. the copyrighted work you say is infringed, or a representative list if there are several;
2. the material you say infringes, with enough detail for us to find it (for example, its URL);
3. your name, address, telephone number and email address;
4. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
5. a statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner; and
6. your physical or electronic signature.

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

Xither’s DMCA agent receives notices through our contact form. Put “DMCA” in the subject line. We aim to respond within 2 business days.

1. remove or disable access to the material;
2. tell the person who provided it, where there is one, and give them a copy of the notice; and
3. keep a record of the notice and our response.

If you believe material you provided was removed by mistake or misidentification, you may send a counter-notification through the same form. It must include:

1. the material removed and where it appeared;
2. a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
3. your consent to the jurisdiction of the federal district court for your address (or, outside the United States, any district where Xither may be found), and that you will accept service from the person who sent the notice;
4. your name, address, telephone number and email address; and
5. your physical or electronic signature.

We forward a valid counter-notification to the person who sent the notice, and may restore the material in 10 to 14 business days unless they tell us they have filed a court action.

We close, in appropriate cases, the accounts of people who repeatedly infringe.
