By accessing or using Xither, you confirm that you are at least 18 years of age, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Xither is an enterprise AI tools directory that provides information about artificial intelligence products, platforms, and services for business use. The Service includes:

• A searchable directory of enterprise AI tools with descriptions, pricing information, compliance data, and user reviews
• Editorial content including insights, analysis, and research reports
• Comparison tools for evaluating AI products side by side
• A "Claim Your Profile" feature enabling vendors to manage their listings
• A tool submission form for suggesting new entries to the directory
• An AI-powered chatbot assistant for navigating the directory

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

Certain features of the Service may require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Vendors may claim their profile on Xither to manage their listing information. By claiming a profile, you represent and warrant that:

• You are an authorized representative of the company whose profile you are claiming
• All information you provide is accurate, complete, and not misleading
• You will promptly update your listing when information changes
• You will not use your listing to make false, deceptive, or misleading claims

Xither reserves the right to verify claimed profiles, reject or remove listings that violate these Terms, and display editorial notes or corrections alongside vendor-provided content. Xither's editorial team maintains independent authority over directory content and ratings.

When you submit content to Xither, including tool suggestions, reviews, or other materials ("User Content"), you grant Xither a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, and distribute such content in connection with the Service.

You represent and warrant that:

• You own or have the necessary rights to submit the content
• The content does not infringe any third-party intellectual property rights
• The content is accurate and not misleading
• The content does not violate any applicable laws or regulations

Xither reserves the right to review, edit, or remove any User Content at our sole discretion without notice.

You agree not to use the Service to:

• Scrape, crawl, or systematically extract data from the Service without prior written permission
• Submit false, misleading, or fraudulent information about AI tools or companies
• Impersonate any person or entity, or falsely claim affiliation with any company
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any unlawful purpose or in violation of any applicable laws

• Engage in any activity that could damage, disable, or impair the Service

The "Xither" name, logo, and all related marks are trademarks of Capsterra, Inc. You may not use our trademarks without our prior written consent.

Tool names, logos, and descriptions remain the intellectual property of their respective owners. Xither displays this information for informational and comparative purposes under principles of nominative fair use.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Xither does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

Directory listings, tool descriptions, pricing information, and compliance data are provided for informational purposes only. Xither makes no representations or warranties regarding the accuracy, completeness, or reliability of any tool information. Always verify information directly with vendors before making purchasing decisions.

AI content currency and volatility. Editorial content on Xither — including insights, guides, comparisons, use cases, listicles, and workbench tools — covers a rapidly evolving field. Vendor pricing, model versions, performance benchmarks, capability claims, integration patterns, and regulatory references reflect our best understanding at the time of publication and may change without notice. We make a reasonable effort to keep cited primary sources current via the Sources section on each article and our scheduled link-validation process, but you should always verify figures, prices, and product capabilities directly with the vendor or primary publisher before acting on them.

Anonymized illustrations are not specific claims. Some articles describe outcomes using anonymized framing (for example, “a multinational bank reduced false positives by 30%” or “manufacturers see significant downtime reductions from predictive maintenance”). • Your access to or use of (or inability to access or use) the Service

IN NO EVENT SHALL XITHER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO XITHER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Xither and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

The Service may contain links to third-party websites, tools, or services. These links are provided for your convenience only. Xither has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

Your use of third-party services is subject to those services' own terms and privacy policies. Xither does not endorse any third-party products or services mentioned in the directory.

Access to the Xither API (when available) is subject to additional terms and rate limits. Unauthorized use of the API, including exceeding rate limits or using the API to build competing directory services, is prohibited and may result in termination of access.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules, conducted in Delaware.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Xither.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification to registered users.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
